Terms of service

These terms govern your use of aarishya.com and any order you place through it. By browsing the site or completing a purchase you accept them. If you do not accept them, please do not use the site.

1. Who we are

Aarishya is a natural skincare brand operating from Ahmedabad, Gujarat, India. References to "we", "us" and "our" mean Aarishya; references to "you" mean the person using the site or placing an order.

2. Eligibility

You must be at least 18 years old and capable of entering a contract under the Indian Contract Act, 1872 to place an order. If you are ordering on behalf of a business, you confirm you are authorised to bind it. We currently ship only to addresses within India.

You do not need an account to browse the store or to place an order. To see your past orders you log in with your mobile number and a one-time password, so that only the person who can receive that number can see what was ordered against it.

3. Products, safe use and storage

We describe every product as accurately as we can, including its full ingredient list, weight and intended use. Because our formulations use plant-derived materials, small variations in colour, aroma and texture between batches are normal and are not defects.

Photographs are indicative. Screen calibration means colours will not match a physical product exactly. Nothing on this site is medical advice, and no product we sell is intended to diagnose, treat or cure any condition. If you have a skin condition, are pregnant, or are under a dermatologist's care, consult them before using a new product.

Patch test before first use. Apply a small amount to the inner arm and wait 24 hours. Stop using the product if irritation, redness, itching, burning or any discomfort occurs. Avoid contact with the eyes and with broken skin. Because our products are made from natural ingredients, individual reactions vary with skin type and sensitivity. If you are pregnant, nursing, taking medication, have a medical condition, or are allergic to any food, consult an Ayurvedic medical practitioner or your doctor before use.

Storage. Keep out of the reach of children; our products are not recommended for children. Store in a cool, dry place away from direct sunlight. Do not let the powder get damp — moisture causes it to form lumps — and seal the pouch after every use. Do not use a product if the safety seal is broken or missing; tell us instead and we will replace it.

4. Pricing and payment

All prices are in Indian rupees and include GST unless stated otherwise. Shipping charges and any discounts are shown at checkout before you pay.

Every order is prepaid — we do not offer cash on delivery. You can pay by card (Visa, Mastercard, RuPay, American Express or Discover), UPI, net banking, a wallet, or a buy-now-pay-later option, subject to what your bank and our payment gateway support at the time.

If a payment fails or is taken twice, the amount is refunded automatically to the source you paid from, normally within 7 to 10 working days. You do not need to raise a request for that, though do tell us if it has not arrived.

We may change prices at any time, but a change never affects an order already confirmed. If a product is listed at an obviously incorrect price because of a technical or human error, we may cancel the order and refund you in full rather than fulfil it, and we will contact you before doing so.

Payment is taken through our payment gateway. We verify every payment server-side before an order is confirmed, and we recompute the order total from our own catalogue — the amount charged is always the amount our records support, never a value supplied by your browser.

5. Order acceptance

Your order is an offer to buy. A contract is formed only when we send you an order confirmation. We may decline an order where the product is out of stock, the delivery address is not serviceable, a payment cannot be verified, a discount code has been misused, or we reasonably suspect fraud. If we decline an order you have paid for, we refund it in full.

6. Delivery

Delivery timelines given on the site and at checkout are estimates in working days, not guarantees. Once a parcel has been handed to a courier, delivery is subject to their network and to conditions outside our control such as weather, strikes and local restrictions. Full details are in our shipping policy, which forms part of these terms.

Risk in the goods passes to you on delivery to the address you gave us. Please give a complete address and a phone number that is reachable — repeated failed delivery attempts caused by an incorrect address may result in a return to origin, and the outbound shipping cost is not refundable in that case.

7. Returns and refunds

For hygiene and safety reasons we do not accept returns or exchanges on any product, opened or unopened. Where an order arrives damaged, defective or incorrect we replace it or refund it in full, and an order can be cancelled free of charge at any point before dispatch. 8. Discount codes and offers

Promotional codes are single-use per customer unless stated otherwise, cannot be combined, have no cash value, and expire on the date shown. We may withdraw an offer at any time and may cancel orders where a code has been shared, resold or used in a way it was not intended for.

9. Reviews and user content

If you submit a review, you confirm it reflects your genuine experience and grant us a non-exclusive, royalty-free licence to publish it on the site and in our marketing, with your first name and last initial. We may decline to publish or may remove content that is abusive, unlawful, contains personal information, or makes medical claims we cannot substantiate.

10. Intellectual property

The Aarishya name, logo, product names, photography, copy and site design belong to us and are protected by copyright and trade mark law. You may not reproduce them commercially without our written permission. You may share links to our pages freely.

11. Acceptable use

Do not attempt to gain unauthorised access to the site, scrape it at a rate that degrades service for others, interfere with its security features, or use it to transmit malicious code. We may suspend access where we reasonably believe any of these is happening.

12. Liability

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, or your rights under the Consumer Protection Act, 2019.

Subject to that, and to the maximum extent permitted by law, our total liability arising from an order is limited to the amount you paid for that order. We are not liable for indirect, incidental or consequential loss, loss of profit, loss of business or loss of opportunity, and we are not liable for a reaction to a product where the ingredient list was published, the product was used otherwise than as directed, or a patch test was not carried out as we recommend.

We give no warranty that a product will produce a particular result. Skin differs from person to person, and an outcome that differs from the one you hoped for is not a defect.

13. Force majeure

We are not responsible for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, government action, civil disturbance, courier network failure or utility outages.

14. Changes to these terms

We may update these terms. The version published on the site when you place an order is the version that governs that order. Material changes will be flagged on this page with a new update date.

15. Governing law and disputes

Subject to Ahmedabad jurisdiction. These terms are governed by the laws of India, and the courts at Ahmedabad, Gujarat have exclusive jurisdiction over any dispute arising from them.

16. Personal use only

Our products are sold to you for your own personal use. You may not resell them, list them on a marketplace, repackage or decant them, alter a pack or a label, or hold them out as your own. We may decline or cancel any order we reasonably believe is placed for resale, and we are not responsible for a product that has been resold, repackaged or altered by anyone other than us.

17. Availability of the site and the range

We may change, suspend or withdraw the site, any product, any price or any offer at any time and without notice. We do not warrant that the site will be available uninterrupted or error free. Where a description, image, price or other detail on the site is wrong because of a typographical or technical error, we may correct it, and we may cancel and refund an affected order rather than fulfil it.

The site links to pages we do not control, such as courier tracking and payment pages. We are not responsible for their content or their practices.

18. Your responsibilities and indemnity

You are responsible for the accuracy of the details you give us, for keeping products out of the reach of children, for patch testing before first use, and for using every product as directed on the pack and on its product page.

You agree to indemnify us against any claim, loss, damage, cost or expense we suffer arising from your breach of these terms, your misuse of a product, your resale of a product, or any content you submit to us.

19. Misuse of our policies

Our refund, replacement and discount policies exist for customers acting in good faith. Where we reasonably believe a claim is not genuine, that a discount code has been abused, or that a pattern of claims across orders is not credible, we may decline the claim, withhold a refund, cancel pending orders and refuse to accept future orders from you. Refunds are made only to the original payment method.

20. General

If any provision of these terms is held to be invalid or unenforceable, that provision is severed and the rest continue in full force. A delay or failure by us to enforce any provision is not a waiver of it. These terms, together with our shipping policy, Return & Refund policy and privacy policy, are the entire agreement between us about your use of the site and any order you place. We may assign or transfer these terms to a successor of our business; you may not assign yours without our written consent. Nothing in these terms creates a partnership, agency or employment relationship.
